1.Introduction

Purpose of This Privacy Policy. Catch Ride operated by Catch Ride, LLC, ("Catch Ride," "we," "us," or "our") is a private, professional infrastructure platform built specifically for the equestrian industry. This Privacy Policy describes how Catch Ride collects, uses, discloses, and otherwise processes information, including personal information, in connection with: (a) the Catch Ride platform, including our mobile application currently referred to as Catch Ride and our website located at Catchride.co, together with all related content, functionality, and features (collectively, the "Platform"); and (b) any other online or offline interactions you have with us where this Privacy Policy is made available to you.

Relationship to Terms and Conditions. This Privacy Policy is incorporated by reference into, and forms part of, the Catch Ride Terms and Conditions (the "Terms"). By accessing, browsing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be legally bound by this Privacy Policy and the Terms. If you do not agree to this Privacy Policy, you must not access or use the Platform. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms.

Professional-Only Platform. The Platform is a private, professional infrastructure tool built specifically for equestrian industry professionals. It is intentionally closed to unverified or public users. It is not directed to, and may not be used by, consumer clients or individuals under the age of eighteen (18). By using the Platform, you represent and warrant that you meet the eligibility requirements described in the Terms.

Jurisdiction and Governing Law. The Platform is operated from the United States, and your use of the Platform, the Terms, and this Privacy Policy are governed by the laws of the State of South Carolina, without regard to conflict of laws rules. Depending on where you reside or are located, additional privacy rights and obligations may apply under applicable state, federal, or foreign data protection laws. This Privacy Policy is intended to be interpreted consistently with such laws to the extent they apply to Catch Ride.

Updates to This Privacy Policy. We may revise, update, or otherwise modify this Privacy Policy from time to time in our sole discretion. Except where a different form of notice is required by applicable law, we will provide notice of material changes by: (a) posting the updated Privacy Policy on the Platform; (b) providing an in-app notification; and/or (c) sending an email to the email address associated with your account. Changes will be effective as of the date indicated at the top of the Privacy Policy, unless a later date is stated or a different effective date is required by law. Your continued access to or use of the Platform following any such changes constitutes your acceptance of the revised Privacy Policy. If you do not agree to the revised Privacy Policy, you must cease all access and use of the Platform.

2.Scope and Applicability

Covered Individuals. This Privacy Policy applies to all Users of the Platform, including: (a) Trainer Users or Trainers, meaning professionals responsible for managing horses for sale, lease, or weekly lease and coordinating services for such horses, including while traveling and attending shows; (b) Vendor Users or Vendors, meaning vetted professional service providers in the equestrian industry, including without limitation braiders, clippers and other grooming-related service providers, grooms, bodywork specialists (e.g., massage, chiropractic, other accepted modalities), farriers, shippers and/or transporters, and other professional equestrian service providers accepted by Catch Ride; (c) Barn Manager Users or Barn Managers, meaning individuals operating as assistants or support professionals under Trainer accounts with permission-based, limited access; and (d) any other professional categories expressly approved by Catch Ride from time to time (collectively, "Users").

Excluded Individuals and Activities. This Privacy Policy does not apply to: (a) consumer end-clients of Trainers or Vendors, except to the limited extent their information is incidentally included in User Content or communications on the Platform; (b) employment applicants or employees of Catch Ride (who may be subject to separate notices or policies); (c) any third-party websites, services, or platforms that may be linked from the Platform but are not controlled by Catch Ride; or (d) activities outside the Platform, including offline contractual arrangements and financial transactions between Trainers, Vendors, Barn Managers, and their respective clients, which Catch Ride does not manage, control, or process.

Geographic Reach. The Platform may be used by Users located in different jurisdictions. Regardless of where you are located, you acknowledge that your information will be processed in the United States and potentially in other jurisdictions where Catch Ride or its service providers maintain facilities, subject to applicable law and the safeguards described in this Privacy Policy.

3.Definitions

Personal Information. For purposes of this Privacy Policy, "Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable natural person. Personal Information does not include: (a) de-identified, anonymized, or aggregated data that cannot reasonably be used to identify you; or (b) information relating solely to legal entities (such as a business name without any associated contact person), except where such information also identifies an individual.

User Content. "User Content" has the meaning given in the Terms and generally includes any information, data, text, or materials submitted, uploaded, transmitted, or otherwise provided by you or on your behalf through or in connection with the Platform, including without limitation: (a) horse listings, descriptions, photos, videos, and related materials; (b) Vendor service descriptions, professional profiles, photos, videos, and service-specific details; (c) availability, scheduling, and capacity data; (d) communications or messages between Users; and (e) feedback, suggestions, and other materials provided to Catch Ride.

Role. "Role" means the category of User account type assigned to you upon registration and verification, which may be one of the following: (a) Trainer; (b) Vendor; (c) Barn Manager; or (d) any other professional category expressly approved by Catch Ride from time to time. Your Role determines your level of access, visibility, and functionality within the Platform, as further described in the Terms.

Other Terms. "Services" and "Platform" have the meanings given in the Terms and include the Catch Ride website, mobile application, and all related content, functionality, and features. Other capitalized terms used in this Privacy Policy but not defined herein have the meanings assigned in the Terms.

4.Categories of Personal Information We Collect

Depending on your Role and how you interact with the Platform, we may collect the following categories of Personal Information:

(a) Identification and Contact Information. Full name; business name and Role; professional title or capacity; mailing address and/or primary service regions; telephone number(s); email address(es); and account username and other identifiers associated with your account.

(b) Professional Profile and Credential Information. Information regarding your status as an equestrian professional, for example but not limited to, your representation that you are a United States Equestrian Federation (“USEF”) professional in good standing or the functional equivalent in another jurisdiction; USEF or equivalent governing body affiliation and professional standing, where provided; professional references such as trainer references, vendor references, or vendor-to-vendor references, including names and contact details of referees; documentation or evidence of applicable licenses, certifications, insurance, or other professional credentials, as requested during the application or vetting process; service-specific information such as training, equipment, areas of specialization, geographic coverage, and travel circuits; and Vendor cancellation policies and other professional practice parameters.

(c) Account, Configuration, and Role Information. Your Role; linked relationships, such as Barn Managers associated with a Trainer account or Trainers who also hold Vendor Roles; permission-based access settings and designations within Trainer accounts; saved searches, preferences, and configuration choices such as, saved horse searches, saved vendors, notification preferences; and founding or early access status, subscription tier, and feature access where applicable.

(d) Horse- and Service-Related Information. Details regarding horses listed on the Platform, which may include discipline, height, age, tags, show history summaries, and other attributes determined by Catch Ride; horse availability and location information such as, show-based availability, city or region-based availability, and date-based calendars; Vendor service offerings and capacities such as, number of horses per day, number of available spaces per load, and half-day versus full-day availability; and past service history, coordination records, and rebooking information associated with your professional activities on the Platform.

(e) Communications and Interaction Information. Messages and other communications you send or receive through the Platform, including coordination of trials, services, and logistics; feedback, surveys, reviews, or suggestions you submit regarding the Platform or other Users; and, where applicable in later phases, activity feed posts and any associated content.

(f) Technical, Usage, and Device Information. Log data such as date and time of access, pages or screens viewed, features used, and other activities on the Platform; device identifiers, device type, operating system, browser type, language preferences, and settings; IP address and approximate location derived from your IP address; cookies and similar technologies used to recognize your browser or device, authenticate your session, and analyze Platform usage; and information regarding performance of the Platform, error logs, and diagnostics.

(g) Marketing and Communication Preferences. Records of your consent and preferences for receiving marketing communications or platform updates; unsubscribes, opt-outs, and preference changes; and information regarding your engagement with any marketing communications we send, including email opens or other interaction data, where permitted by law.

(h) Payment Information. If and when Catch Ride introduces subscription fees or other charges, we may collect billing information such as payment card details or other payment method information. Such information will be processed through third-party payment processors, as further described in Section 8 below.

(i) Other Information You Choose to Provide. Any additional information you voluntarily provide when you contact us through email, support requests, or other correspondence; and information about third parties, such as references or colleagues, that you choose to submit subject to your obligation to obtain any necessary permissions before providing their information.

5.How We Collect Personal Information

We collect Personal Information in a variety of ways, including:

(a) Directly From You. We collect Personal Information that you provide directly to us, including when you: create, register, or update your account for your Role; complete our professional verification or vetting processes and provide references, credentials, or supporting documentation; create or update horse listings, service offerings, availability, and scheduling preferences; communicate with other Users via in-app messaging or other Platform tools; contact us with questions, feedback, or support requests; participate in surveys, beta programs, or feedback initiatives; or adjust your notification or marketing preferences.

(b) From Other Users and Third Parties. We may receive Personal Information about you from: other Users, such as Trainers, Vendors, or Barn Managers who refer to you, include your information in references, or otherwise identify you in User Content; professional references you have provided, who may respond to our inquiries regarding your professional conduct, reliability, or credentials; show management systems, governing bodies, such as USEF or functional equivalents, or other integrations if and when you authorize such connections and they become available as features; and third-party service providers who support our verification, vetting, onboarding, or fraud-prevention activities.

(c) Automatically Through the Platform. When you access or use the Platform, we and our service providers may automatically collect certain technical and usage information using server logs and diagnostic tools; cookies and similar technologies; and analytics tools that help us understand how Users interact with the Platform, what features are used, and how performance can be improved.

(d) Publicly or Professionally Available Sources. Where permitted by applicable law and consistent with our professional verification objectives, we may supplement the information we collect with information from publicly available or industry sources (for example, professional association websites, show results databases, or similar resources) to verify or update professional credentials and standing.

6.How We Use Personal Information

(a) To Operate, Maintain, and Provide the Platform and Services. Creating, administering, and maintaining your account; providing access to Platform features appropriate for your Role; enabling you to create and manage horse listings, Vendor profiles, availability calendars, and coordination records; facilitating professional-to-professional discovery, including Vendor discovery and horse sourcing by location, show, or other criteria; and enabling direct in-app communication and coordination of trials and services between Users.

(b) To Verify Eligibility, Conduct Vetting, and Maintain a Professional-Only Environment. Evaluating your eligibility for your Role consistent with our verification requirements; reviewing and confirming references and professional credentials; conducting re-verification or additional vetting from time to time to ensure ongoing compliance with eligibility standards; and enforcing our policies regarding proprietary, closed, professional access and preventing unauthorized or fraudulent accounts.

(c) To Maintain Professional Confidentiality and Role-Based Visibility. Implementing and enforcing visibility rules such that Trainer and Vendor profiles, and their professional contact information, are generally visible only to verified Users and not to the general public; supporting client-facing materials, such as Trainer-generated horse lists, that intentionally omit certain sensitive details, including, without limitation, seller identity, Trainer contact information, exact barn location, and USEF numbers, so that the Trainer remains central to the client relationship; and applying permission-based access rules for Barn Managers and other role-based permissions consistent with the Terms.

(d) To Improve, Develop, and Enhance the Platform. Analyzing how Users access and use the Platform and its features; performing analytics and generating aggregated or anonymized statistics regarding professional usage patterns, industry trends, and platform performance; identifying usability problems and technical performance issues, and developing new products, services, and features; and conducting A/B tests, pilot programs, or phased roll-outs to improve platform design, functionality, and reliability.

(e) To Communicate With You. Responding to your inquiries, requests for support, and other communications; sending administrative or service-related communications, such as account notices, verification requests, feature updates, security alerts, or changes to the Terms or this Privacy Policy; providing onboarding, training, or informational materials to help you use the Platform effectively; and, where permitted by law, sending you professional or marketing communications regarding platform features, events, promotions, or other offerings that may be of interest to you, subject to your right to opt out.

(f) To Enforce Our Terms, Community Standards, and Legal Obligations. Monitoring, reviewing, or recording content, communications, listings, and activity on the Platform for purposes of ensuring compliance with the Terms, community standards, and applicable law; detecting, preventing, and addressing fraud, security incidents, abuse, misconduct, or other harmful activity; investigating, removing, editing, or refusing to display any content or account that may violate our Terms, community standards, or applicable law; and complying with legal obligations, regulatory requirements, lawful requests, and court orders, and enforcing or defending our legal rights.

(g) To Support Potential or Future Payment-Related Programs. If and when we introduce Vendor payment protection or other payment-related features, using certain information to administer such programs, manage non-payment resolution, and communicate with Users regarding such programs; and coordinating with third-party payment processors to the extent you elect to participate in any such programs, in accordance with any additional terms that may apply.

(h) For Security, Fraud Prevention, and Integrity of the Platform. Securing the Platform, including authentication and access control; identifying and addressing unauthorized access, automated scraping, or attempted circumvention of verification and security measures; and preserving the integrity, trust, and safety of the professional community on the Platform.

(i) For Any Other Purpose With Your Consent. Where applicable law requires consent for a particular use of Personal Information, we will obtain your consent and use your Personal Information only for the specifically disclosed purposes, unless we are permitted by law to use the information without further consent.

7.Aggregated, De-Identified, and Anonymized Data

Catch Ride may create aggregated, de-identified, or anonymized datasets derived from User Content and other Personal Information, provided that such data does not identify you, your clients, or other individuals by name or other direct identifier. We may use such aggregated, de-identified, or anonymized data for: analytics and business intelligence; product development and feature planning; benchmarking, industry insights, and trend analysis; and internal research and the improvement of our operations and services. Catch Ride retains all right, title, and interest in and to such aggregated or anonymized data. We will not attempt to re-identify individuals from data that we have taken reasonable steps to de-identify or anonymize, except as required by law or as necessary to verify our de-identification processes.

8.How We Share Personal Information

Catch Ride does not sell your personal information. We may disclose Personal Information to the following categories of recipients, in each case consistent with this Privacy Policy, the Terms, and applicable law:

(a) Other Users and Platform Participants. Certain elements of your professional profile, including your name, Role, professional contact information, service offerings, and availability, may be visible to other verified Users in order to facilitate coordination and professional collaboration. The Platform is intentionally designed so that profiles and professional information are not visible to the general public. Messages and communications you send to other Users through the Platform will be visible to those Users and, to the extent necessary, may be accessed by Catch Ride for support, enforcement, or security purposes as described in this Privacy Policy and the Terms.

(b) Service Providers. We may share Personal Information with trusted third-party service providers that perform services on our behalf, including: cloud hosting, infrastructure, and storage providers; managed service providers and platform maintenance partners; analytics, logging, and performance monitoring providers; customer support, communications, or email service providers; verification, vetting, and background-check partners, where applicable; and legal, accounting, or other professional advisors who assist us in our business operations. These service providers are permitted to use Personal Information only as necessary to provide services to Catch Ride and are contractually required to maintain the confidentiality and security of such information and to process it solely in accordance with our instructions and applicable law.

(c) Verification References and Professional Contacts. In connection with your application or ongoing verification, we may contact references you have provided and share limited information as necessary to obtain verifications or confirmations of your professional conduct, reliability, and qualifications. We may receive information from such references, which will be treated as part of your professional verification record.

(d) Third-Party Payment Processors. If and when payment processing is introduced, we may share billing and payment information with third-party payment processors as necessary to process transactions. Such processors operate under their own terms and privacy policies, for which Catch Ride bears no responsibility.

(e) Future Integration Partners. Catch Ride is working toward integrations with select show management systems and USEF data services. To the extent any such integrations require sharing of User data, Catch Ride will provide notice and, where required, seek your consent prior to sharing.

(f) Affiliates and Corporate Transactions. We may share Personal Information with our corporate affiliates, who are entities under common control with Catch Ride, for purposes consistent with this Privacy Policy. In the event of a corporate transaction, such as a merger, acquisition, reorganization, sale of assets, investment, or similar transaction, your Personal Information may be transferred to a successor or other entity as part of the transaction, subject to confidentiality obligations and this Privacy Policy or a successor policy that provides materially similar protections.

(g) Legal, Regulatory, and Safety-Related Disclosures. We may disclose Personal Information to law enforcement agencies, governmental authorities, regulators, courts, or tribunals when we believe disclosure is reasonably necessary to: comply with applicable laws, regulations, legal processes, or governmental requests; protect the rights, property, or safety of Catch Ride, our Users, or the public; enforce the Terms, community standards, or other agreements; investigate, prevent, or address fraud, security, or technical issues, or alleged misconduct on or in connection with the Platform; or obtain legal advice or respond to legal proceedings.

(h) With Your Consent or at Your Direction. We may share your Personal Information with third parties when you expressly request or authorize us to do so, including, for example, where you connect your account with third-party services or integrate external tools or data sources into your use of the Platform, where such integrations are available.

9.Cookies and Similar Technologies

We and our service providers may use cookies and similar technologies on the Platform to: enable core functionality, such as authentication and session management; remember your settings and preferences; analyze usage, performance, and traffic patterns; and help secure the Platform and detect fraudulent activity. Depending on your browser or device settings, the Platform may use: strictly necessary cookies required for operation of the Platform; functional cookies to remember your preferences; and performance and analytics cookies to understand and improve Platform usage.

Your Choices Regarding Cookies. Most browsers allow you to refuse or delete cookies by modifying your browser settings. If you disable or reject certain cookies, some features or functionalities of the Platform may not operate as intended or may be unavailable. As of the effective date of this Privacy Policy, the Platform is a professional, closed environment and is not designed for general consumer advertising. We do not use your Personal Information to serve third-party behavioral advertising on the Platform.

10.Data Retention

We retain Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to: provide the Platform and related services; maintain business and professional records; comply with legal, regulatory, or accounting obligations; and resolve disputes and enforce our agreements. Upon suspension or termination of your account, Catch Ride may, but is not obligated to, retain data, content, or communications associated with that account, subject to applicable law and our internal data retention policies. Catch Ride has no obligation to store or maintain any User Content after termination of your account.

Retention periods are determined based on factors such as: the nature and sensitivity of the Personal Information; the risks of harm from unauthorized use or disclosure; the purposes for which we process the information and whether those purposes can be achieved through other means; and applicable legal, regulatory, contractual, or industry-standard retention requirements. At the end of the applicable retention period, we will delete or anonymize Personal Information in accordance with our internal policies and applicable law. In some cases, we may retain de-identified or aggregated data for longer periods for analytics, product development, or other legitimate business purposes.

11.Data Security

Security Measures. Catch Ride uses commercially reasonable technical, organizational, and administrative measures to protect Personal Information within its control against unauthorized access, disclosure, alteration, or destruction. These measures may include: access controls and authentication mechanisms; role-based access limitations for Barn Managers and other Users; network and application security controls; regular monitoring and logging of Platform activity; and contractual confidentiality obligations with employees, contractors, and service providers who have access to Personal Information.

No Absolute Security. While we endeavor to maintain appropriate security measures, no system or transmission over the internet can be guaranteed to be 100% secure. You acknowledge and agree that you provide information at your own risk and that Catch Ride is not liable for unauthorized access, disclosure, or loss of data except to the extent required by applicable law.

Your Security Responsibilities. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must not permit any unauthorized person to access or use your account and must promptly notify us of any suspected or actual unauthorized use or security breach. You must handle any non-public information obtained from the Platform, including the professional contact information, availability, and service history of other Users, in accordance with the Terms and this Privacy Policy and must not use such information to build or contribute to any competing platform, database, or service.

Incident Response. In the event we become aware of a security incident that affects Personal Information, we will take reasonable steps to investigate, mitigate, and, where required by law, notify affected individuals and/or relevant authorities.

12.Confidentiality and Role-Based Visibility

Private Professional Environment. The Platform is designed as a private, professional environment. Subject to the Terms and this Privacy Policy: (a) Trainer profiles, Vendor profiles, and professional contact information are generally visible only to verified Users and not to the general public; and (b) client-facing lists generated by Trainers or Barn Managers are intentionally configured to omit sensitive details, including without limitation seller identity, Trainer contact information, exact barn location, and USEF numbers.

Barn Manager Access. Barn Managers have permission-based, limited access to Trainer accounts, as further described in the Terms. Trainers remain fully responsible for: selecting, supervising, and managing any Barn Managers linked to their accounts; ensuring that Barn Managers comply with this Privacy Policy and the Terms; and all actions and communications of Barn Managers on the Platform, which are deemed acts of the Trainer.

User Confidentiality Obligations. You are responsible for maintaining the confidentiality of non-public information you obtain through the Platform regarding other Users and their professional activities. Without limiting the Terms, you agree not to: (a) disclose such information to any third party except as strictly necessary to conduct your legitimate professional activities and only in compliance with applicable law; or (b) use such information to build, operate, or contribute to any competing platform, database, or service. Catch Ride will use commercially reasonable efforts to maintain the confidentiality of User professional information, subject to applicable legal requirements, enforcement obligations, and legitimate business purposes.

Monitoring and Enforcement. Catch Ride reserves the right, but does not undertake any obligation, to monitor, review, or record any content, communications, listings, or other activity on the Platform; investigate potential violations of this Privacy Policy, the Terms, or applicable law; and take enforcement actions as described in the Terms.

13.Third-Party Services and Links

The Platform may contain links to or integrations with third-party websites, applications, or services that are not controlled by Catch Ride, including without limitation show management systems, governing body data services, cloud service providers, payment processors, and other professional tools. Any Personal Information provided to or collected by such third parties is subject to their own privacy policies and practices, not this Privacy Policy. Catch Ride does not control and is not responsible for the privacy, security, or data handling of any third party. You are responsible for reviewing the privacy policies and terms applicable to any third-party sites or services you choose to access or integrate with the Platform. Where applicable, Catch Ride requires third-party service providers engaged to assist with Platform operations to maintain the confidentiality and security of User information under appropriate contractual protections.

14.International Transfers

Personal Information may be stored and processed in the United States and in other jurisdictions where Catch Ride or its service providers maintain facilities. These jurisdictions may have data protection laws that differ from those in your country of residence. Where we transfer Personal Information across borders, we will take appropriate measures to ensure that such information is handled in accordance with this Privacy Policy and applicable law, which may include: entering into data protection or data processing agreements with service providers that include appropriate safeguards; and implementing standard contractual provisions or comparable mechanisms where required by foreign data protection laws, to the extent applicable. By using the Platform and providing us with Personal Information, you acknowledge that your Personal Information may be transferred to and processed in jurisdictions outside your own, including the United States.

15.Do Not Track and Similar Signals

Certain web browsers may provide an option to send Do Not Track signals or similar mechanisms to online services. As there is no universally accepted standard for responding to such signals, the Platform does not currently respond to browser-based Do Not Track signals. You may manage certain tracking technologies, such as cookies, through your browser settings as described in Section 9.

16.Your Rights and Choices

Depending on your jurisdiction and subject to applicable law, you may have certain rights and choices with respect to your Personal Information:

(a) Account Information and Profile Management. You may review and update certain account information, professional profile details, and configuration settings directly through your account on the Platform. You are responsible for ensuring that the information you provide is and remains true, accurate, current, and complete and for promptly correcting or updating such information as needed.

(b) Access and Correction. Where required by law and upon reasonable request, you may have the right to: request confirmation of whether we maintain Personal Information about you; request access to the Personal Information we hold about you; and request that we correct or update inaccurate or incomplete Personal Information.

(c) Deletion and Restriction. Depending on your jurisdiction and subject to applicable exceptions, you may have the right to: request that we delete certain Personal Information about you, subject to our need to retain such information for legitimate business purposes or legal obligations; and/or request that we restrict processing of your Personal Information in certain circumstances. Please note that Catch Ride may retain certain information as required by law, for legitimate business purposes, or for backup and archival purposes, in accordance with Section 10.

(d) Objections and Opt-Outs. You may object to certain processing of your Personal Information, particularly where we are relying on legitimate interests. You may opt out of receiving marketing emails or similar promotional communications by following the unsubscribe instructions in those communications or updating your communication preferences in your account, where available. We may still send you non-marketing, service-related communications.

(e) Data Portability. Where required by applicable law, you may request a copy of your personal information in a structured, machine-readable format.

Exercising Your Rights and Limitations. To exercise any of the rights described in this Section, please contact us using the contact details set forth in Section 17 below. We may need to verify your identity before we can respond to your request. We will respond to your request within the timeframe required by applicable law. Where permitted by law, we may charge a reasonable fee or deny requests that are excessive, repetitive, manifestly unfounded, or not required by applicable law. 17.Children and Minors

The Platform is intended only for professional Users who are at least eighteen (18) years of age and legally able to enter into contracts. We do not knowingly collect Personal Information from individuals under the age of 18. If we become aware that we have inadvertently collected Personal Information from an individual under the age of 18 in connection with the Platform, we will take reasonable steps to delete such information, except to the extent retention is required by law. Trainers, Vendors, and Barn Managers are solely responsible for their own compliance with any obligations relating to minors in their professional activities. End-clients, including minors, do not receive direct access to the Platform.

18.Relationship to Terms and Conditions

This Privacy Policy is incorporated into and forms part of the Terms. In the event of any conflict between this Privacy Policy and the Terms with respect to data collection, use, or disclosure, this Privacy Policy shall govern to the extent of the conflict, except where the Terms expressly allocate risk, disclaim liability, or set forth limitations of liability for data-related issues, in which case the Terms shall control. Any provisions of this Privacy Policy that by their nature should survive termination of your account or cessation of your use of the Platform, including without limitation provisions relating to confidentiality, de-identified data, and limitations of liability as incorporated through the Terms, shall so survive in accordance with the Terms.

19.Governing Law

This Privacy Policy and any disputes arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of South Carolina, without giving effect to any choice or conflict of law provision or rule that would require or permit the application of the laws of any other jurisdiction, consistent with the governing law provisions of the Terms and Conditions.
